Should Amazon sellers form an LLC?

If you're selling on Amazon to earn more for your family or to change direction, you don't need an LLC to start, because Amazon accepts individuals. Many sellers form one anyway, since they're the seller of record, and it's simpler to register the account under the right name once. File a trademark when you have a brand you plan to keep.

What an LLC changes on Amazon

Amazon says you don't need to be an LLC or a registered business to sell. Your selling plan, Individual or Professional, is a separate choice from your business type.

An LLC gives the business its own legal owner. The SBA says that protects you from personal liability in most instances. It won't cover debts you personally guarantee, and it can fall apart if you mix business and personal money, so keep a separate bank account from the first sale.

Insurance can start sooner than you think

Amazon requires commercial liability insurance of at least $1 million within 30 days after your gross proceeds pass $10,000 in a month. From November 2, 2026, sellers in categories with enhanced safety requirements need the same cover whatever their sales. Those categories include children's, cosmetic, ingestible and lithium battery products.

An LLC doesn't replace this. The policy's insured name has to match your legal entity name, though a single-member LLC can use its trade name.

Protect the brand

An LLC doesn't protect your brand name. A trademark does, and it's how you get into Amazon Brand Registry. Amazon accepts a pending application, so you don't have to wait for registration. Here's what Amazon asks for.

Run a free trademark search before you print packaging. It also shows whether the .com looks open.

From filing to first sale

Check the name first. Then form the LLC, get an EIN and open a bank account in the LLC's name. Register on Amazon with the LLC's exact name. File your trademark, and enroll in Brand Registry once you have an application number. Line up insurance before your category or your sales require it.

Questions

Do I need an LLC to sell on Amazon?

No. Amazon accepts individual sellers. An LLC is a choice about liability and how you want to own the business.

Can I switch my Amazon account to an LLC later?

Yes, but Amazon's staff say a legal entity change can start a verification review. Contact Seller Support first.

Does an LLC replace product liability insurance?

No. Amazon requires commercial liability insurance once you pass its threshold, or from the start in some categories, whether or not you have an LLC.
