Questions

How much does it cost to trademark a name?

With us it's $200, attorney included, plus the USPTO's $350 per class. That's $550 for one class.

Do I need a trademark if I have an LLC?

They do different jobs. An LLC registers your company with a state. A trademark protects your brand name across the country for what you sell. Forming an LLC doesn't give you trademark rights.

Can I trademark a name before I start selling?

Yes. You can file on intent to use, which holds your place in line. Before it registers you show real use with a Statement of Use, and the USPTO charges $150 per class for that.

Do I need a trademark or a copyright?

A trademark protects what identifies your brand, like a name or logo. A copyright protects creative work, like writing, music or photos. A business name is a trademark question.

Can I have a trademark without registering?

You can get some rights from using a name, but only where you actually do business. Registering gives you a nationwide claim and the right to use the ® symbol.

Can I trademark my own name?

Often, but a last name alone is usually refused until it's become known as a brand. Using a living person's name needs their written consent.

Can I trademark a phrase?

Yes, if it works as a brand. A common saying or something only printed as decoration usually gets refused.

Can I trademark a logo made with AI?

A trademark depends on using the logo as your brand, not on who drew it. Copyright in AI art is a separate and less settled question, so ask a lawyer if that matters to you.

Do I need a trademark attorney?

Applicants based outside the U.S. must use a U.S. attorney. Others don't have to, but a mistake can cost you the filing, so every application here goes through one.

What is a trademark class?

The USPTO sorts goods and services into 45 classes, and you pay per class. Most small businesses need one.

Who files it?

An attorney reviews your application and files it as attorney of record. You answer the questions and sign the declaration yourself.

When do I pay?

Nothing is charged when you sign. The attorney reviews the application, we email you a payment link, and it's filed once you've paid.

Is OpenFile a law firm?

No. OpenFile is software and a filing team, and we don't give legal advice. The attorney who files your application is your attorney of record for it.
